Chapter 15 of the U.S. Bankruptcy Code, was enacted by the U.S. Congress in 2005, specifically to addresses foreign insolvency issues within the U.S.   Chapter 15 sets forth the potential protection which a foreign debtor may obtain through the Federal Bankruptcy Courts, as well as the means in which a creditor may successfully challenge and defeat the debtor’s attempts to secure such protection within the Bankruptcy Courts of the United States.
